In its disclosure appellant denied liability, but stipulated that respondents might file a supplemental complaint making appellant a party to the action. The complaint was filed, appellant answered, and the issues came on for trial before the court. At the opening of the trial appellant objected to the introduction of any evidence under the complaint and moved for judgment on the pleadings.
