Appeal by the plaintiff, Charles S. Kent, from an interlocutory • judgment of the Supreme Court in favor of the defendant Isaac S. West, as committee of the person and property of Asa K. West, entered in the office of the clerk of the county of Onondaga on the 28th day of December, 1897, upon the decision of the court rendered after a trial at the Onondaga Special Term sustaining the said defendant’s demurrer to the plaintiff’s complaint.

Green, J. :

The plaintiff’s causes of action are based, on this state of facts: The defendants George F. and Asa K. West were engaged in business as copartners under the firm name of West Bros. “ As such copartners, they had conducted the business of shoe dealers, as well as to engage in the buying, in their firm and individual names, large amounts of real estate and personal property, and likewise to purchase interests in syndicates.”

In December, 1891, Asa was adjudged a lunatic by a Probate Court in Massachusetts, and the defendant Isaac S. West was appointed guardian of his person. In July,…
