Plaintiff obtained judgment, based upon a verdict, against defendant Standard Oil Company for $10,572 damages for personal injuries resulting from an alleged assault by defendant’s employee. Defendant appeals from the judgment and asserts that the court erred in giving certain instructions and in refusing other instructions requested by defendant.

The complaint alleged that, while plaintiff was a pedestrian upon a public sidewalk adjacent to defendant’s service station, an employee of defendant “did wilfully and unlawfully assault” plaintiff with a revolver and ran after him…
