In this action plaintiff claims that he was assaulted by defendant’s service station manager, who chased him from the station with a revolver in the belief that plaintiff was the accomplice of a bandit who was robbing the station. In running away from the station plaintiff stumbled and received serious injuries for which he seeks to recover damages. At the first trial of the action a jury returned a verdict in plaintiff’s favor in the sum of $10,572 but on appeal the judgment was reversed because of errors in the instructions to the jury on the question of whether defendant’s…
