The defendant was charged by two counts of an information filed in Merced County with separate assaults upon different named individuals with a deadly weapon, to wit, a knife. Both charges grew out of the same affray. The first count charged him with assaulting William Solomon. The second count charged an assault upon Columbus Glynn. All parties concerned in the affray were Negroes. The defendant was tried with a jury composed entirely of Negroes. The jury found the defendant guilty of the crime alleged in the first count, and not guilty of the second charge. Judgment was rendered…
