This is an appeal from the district court’s award of summary judgment dismissing Plaintiff-Appellant’s intentional tort claim against his employer, Defendant-Appellee. The primary focus of the parties’ appellate briefs was the soundness of the district court’s ruling on the intentional tort claim. This Court’s focus, however, is subject matter jurisdiction, which is lacking. Since the district court and this Court are without authority to consider the merits of the case, the district court’s decision on the merits must be vacated, and this matter…
