MEMORANDUM OPINION

OSTEEN, District Judge.

These matters come before the court on the parties’ cross motions for summary judgment. For the following reasons, the court will grant Plaintiff’s motion and will grant in part Defendant’s motion.

I. Background

Plaintiff was one of four prime contractors for the State of North Carolina on a construction project located at the University of North Carolina-Chapel Hill (UNC).
