This is another of the many cases that have grown out of the failure, and the proceedings to wind up the affairs, of the National Express and Transportation Company, a corporation created by the law of the State of Yirginia. The action was brought by the plaintiff, the present appellee, as trustee, acting under the decree of the Chancery Court of the City of Richmond, Yirginia, against the defendant, the present appellant, as sole surviving partner of the banking house of McKim & Company, who are alleged to have been shareholders of the stock of the National Express and Transportation…
