The Superintendent of Banks of the State of New York took possession of the Bank of United States on December 11, 1930, and thereafter proceeded to liquidate its affairs pursuant to the statute (Banking Law, art. 2). This action was subsequently commenced to enforce the statutory liability of the stockholders of the bank and was originally brought against the stockholders of record only; but by supplemental summonses the transferees of certain shares were impleaded by some of the original defendants.
