MEMORANDUM
MOTZ, District Judge.
Plaintiff D & G Flooring, LLC (“D & G”) brought this action against Defendant Home Depot U.S.A., Inc. (“Home Depot”) in Baltimore County Circuit Court seeking recovery on theories of breach of contract (count one), fraud (count two), negligent misrepresentation (count three), violation of the Maryland Consumer Protection Act (count four), promissory estoppel (count five), and defamation (count six).
