Appellee instituted this suit against appellant, alleging that he had been granted a license to retail liquor near the city line of San Antonio for a period of one year, commencing on or about July 9, 1912; that on or about August 23, 1912, appellant, claiming to have information that appellee had violated the law as to the sale of liquors, issued a commission to a notary public to take testimony in regard to the charge; that appellant found from such testimony that appellee had violated the law on or about August 15,1912, by selling liquor to Nettie Cochran and Ida Garretson, girls under the…
