Richard and Jane Bank appeal the district court’s dismissal of their action for failure to state a claim upon which relief can be granted. We reverse and remand for further proceedings.

I. FACTS AND PROCEDURAL HISTORY

In the context of a motion to dismiss, we accept as true facts alleged in the complaint, and construe them in a light favorable to the plaintiffs. Franklin v. Gwin-nett County Pub. Schools, 911 F.2d 617, 619 (11th Cir.1990).
