This is an appeal from a verdict and judgment in favor of defendant in error, hereinafter referred to as plaintiff, against the plaintiffs in error, hereinafter referred to as defendants, in an action brought to recover damages to real estate and growing crops alleged to have been sustained as the result of pollution of a stream with oil and salt water.

The plaintiff in his petition and amendment thereto alleged, in substance, that he was the owner of 90 acres of land in Carter county, Okla., across which flowed a small stream known as Walnut creek, and that the defendants were the owners and…
