LARIMER, Chief Judge.

Bausch & Lomb Incorporated (“B & L”), the plaintiff in this patent infringement action, has filed a motion to preclude defendant Alcon Laboratories, Inc.’s (“Alcon”) patent law expert, Robert L. Harmon, Esq., from testifying at trial. B & L contends that Alcon intends to call Harmon as a witness almost solely for the purpose of having him instruct the jury on Alcon’s view of the law, thereby invading the exclusive province of the court.
