This court reheard Appeal No. 90-1137 in banc to reconsider the principles of lach-es and equitable estoppel applicable in a patent infringement suit.1 A.C. Aukerman Co. sued R.L. Chaides Construction Co. in the United States District Court for the Northern District of California for infringement of Aukerman’s patents, U.S. Patent Nos. 3,793,133 (133) and 4,014,633 (’633). A.
