Before the Court in this 42 U.S.C. § 1983 case is Plaintiff S & M Brands, Inc.’s motion for preliminary injunction. Doe. 4.1 S & M, a tobacco product manufacturer, contends that a model escrow agreement promulgated by the Georgia Attorney General violates the Contracts and Equal Protection Clauses of the United States Constitution, as well as exceeds his authority under Georgia law. If implemented, says S & M, that agreement will cause it irreparable harm. The State insists that S & M is unlikely to succeed on the merits of its claims…
