George W. Latimer, Judge:

The accused in this case was convicted of assault with a dangerous weapon and communicating a threat, violations of Articles 128 and 134, Uniform Code of Military Justice, 50 USC §§ 722 and 728, respectively. The court-martial sentenced him to be dishonorably discharged, to forfeit all pay and allowances, and to be confined at hard labor for five years. The period of confinement was reduced to three years by the convening authority and that sentence, together with the findings, was affirmed by a board of review in the office of The Judge Advocate…
