Appellant was a Senior Airman assigned to the 58th Maintenance Operations Squadron at Kirtland Air Force Base, New Mexico. Before a general court-martial composed of officer and enlisted members, Appellant was tried for ten specifications arising from three charges: willful damage to others’ property (three specifications), assault (five specifications), wrongfully communicating a threat and kidnapping in violation of Articles 109, 128, and 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 909, 928, 934 (2000).
