Appeal from a judgment of the superior court for Pierce county, Card, J., entered October 11, 1912, dismissing an action for wrongful death, upon granting a nonsuit, after a trial before a jury.

In this action, the plaintiff seeks to recover damages on account of the death of his minor son, alleged to have been caused through the negligence of the defendant. It is admitted that the city of Tacoma was, at the time of the accident in question, and for many years had been, the owner of and operating a water system for supplying water to its inhabitants, and as a part of its system, maintained a wooden flume carrying water from the sources of supply to its reservoir.
