Petitioner Daniel Makiel was convicted in an Illinois state court for the murder of Katherine Hoch and the armed robbery of a gas station where she worked. He appeals from the district court’s denial of his petition for a writ of habeas corpus and raises two claims on appeal. First, he argues that his appellate counsel was constitutionally ineffective under Strickland v.
