The issue in this case is whether vacancies in the positions of chief of police and assistant chief of police in Madison Heights are to be filled pursuant to the collective bargaining agreement with the Fraternal Order of Police (fop) or by the collective bargaining agreement with Local 1917, American Federation of State, County and Municipal Employees (afscme).
