*301. Trespass; remedy. *29This was an action brought by plaintiffs in the district court of Atchison county, under § 1, ch. 113, Oomp. Laws 1879, to recover of defendants treble damages, for cutting and carrying away timber from certain real estate belonging to plaintiffs. Verdict and judgment were in favor of plaintiffs, and defendants allege error. The case, as to many of its facts, is peculiar.
