MEMORANDUM OPINION
RICHARD W. ROBERTS, District Judge.
Plaintiff Single Stick, Inc. brought this action against the Secretary of Agriculture, and the United States Department of Agriculture (collectively “USDA”) challenging the USDA’s interpretation of The Fair and Equitable Tobacco Reform Act (“Tobacco Reform Act”), 7 U.S.C. §§ 518-519a, and alleging that the USDA violated the Information Quality Act (“IQA”), 44 U.S.C. § 3516 note.
