James Smith brought an action under the Age Discrimination in Employment Act (ADEA), 29 U.S.C. § 621 et seq. (1982), against his employer, General Scanning, Inc. (GSI), in the United States District Court for the Eastern District of Wisconsin. The district court granted GSI’s motion for summary judgment on the ground that Smith had failed to establish a prima facie case of age discrimination, and Smith appealed.
