SIMPSON, Justice.
Appellant was nominated by the National State’s Rights Party (Alabama branch) at a regular party caucus, for the office of Commissioner, District 3, Dale County, subj ect to the general election to be held on the first Tuesday in November, 1962. His nomination was certified to the Judge of Probate of Dale County, and the name of the appellee Fred Key, was certified to said Judge of Probate as the nominee of the Democratic Party.
