OPINION
FIRESTONE, Judge.
Pending before the court are cross-motions for judgment on the administrative record pursuant to Rule 52.1 of the Rules of the United States Court of Federal Claims (“RCFC”)1 in this military disability ease. The plaintiff, Christopher N. Rominger (“Rominger”), was a former Staff Sergeant with the United States Army (“Army”). Mr. Rominger was separated from the Army because of a physical disability on November 29, 1999, after having served for 13 years, 9 months and 9 days.
