Appeal by the defendant, Olga Kethersole, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 6th day of June 1901, upon the report of a referee.

Laughlin, J.:

The appellant is an actress and the respondent is a theatrical manager, both of many years experience. ' The action was; brought to recover a balance of commissions on the “ profits ” of 'two theatrical seasons under the following contract, to wit:

“ Park Lane, W.
“ Mr Dear Marcus Matér ■;
