This action is based upon a rider attached to an automobile insurance policy, issued by the defendant to the plaintiff, covering loss through the theft of a car by the vendee upon a conditional sales contract. The cause was tried to the court without a jury, and resulted in findings of fact, conclusions of law and a judgment sustaining a recovery in the sum of $715.10. From this judgment, the defendant appeals.
