This was an action to compel the defendant specifically to perform an alleged oral contract. Plaintiffs waged their suit upon the theory and contention that the defendant orally agreed with them that, in consideration of personal care and other services to be rendered by the plaintiffs to the defendant during his lifetime, they were to have, for that period of time, the use and occupancy of certain real estate then owned by the defendant, and further, upon his death, to have the full ownership of the property.
