delivered the opinion of the Commission of Appeals, Section A.

Appellant, Robert Carstairs, brought this suit in the district court of Martin County against W. P. Bomar and Mrs. Chloe A. Nail, as independent executors of the will of James H. Nail, deceased, and against the various devisees under the will of said James H. Nail. None of the defendants reside in Martin County.
