This suit was brought by Robert Carstairs, defendant in error (plaintiff in the trial court and appellant in the Court of Civil Appeals), as sole devisee and legatee of his deceased wife, Elizabeth Carstairs, a daughter of J. H. Nail, deceased, to establish a constructive trust and to recover a one-fourth interest in the estate of the said J. H. Nail, against W. P.
