Although the accused entered a plea of guilty to a charge of desertion, in violation of Article 85, Uniform Code of Military Justice, 10 USC § 885, a board of review reversed his conviction and dismissed the charge. Pursuant to Article 67 (b) (2), The Judge Advocate General of the Army asked this Court to review the correctness of the board of review’s decision.
