Defendant, Ernest Miller,' was charged in the county court of Texas, county with a. “breach of the peace;” was tried, convicted and sentenced to pay a fine of $150 and to serve 120 days in the county jail; and from this judgment and sentence he has appealed.

This case is one arising out of charges filed against persons known as “Jehovah’s. Witnesses.” Many appeals are now pending in this court in cases of this character, and in many of which different issues are raised, and oral arguments have been presented thereon.
