Defendant, Milo Foyil, was charged in the district court of Craig county with the crime of embezzlement; was tried, convicted and sentenced to serve a term of four years in the State Penitentiary, and has appealed.

The defendant was employed as an appraiser for the Commissioners of the Land Office of the State of Okla liorna. He was charged in the information with the embezzlement of $1,306.54 of the funds belonging to said Commissioners.
