On November 6, 1909, Wallace'R. Goldie,plaintiff in error, sued W. T. Corder, defendant in error, in the superior court of Oklahoma county on account for $900 for work and labor done as a salesman in his shoe store from April 15, 1907, to June 15, 1909, at $25 a week, pursuant to an alleged parol contract between the parties. ' For a second cause of action he sued in quantum meruit for work and labor done as a shoe salesman between those dates, alleging said services to be • reasonably worth $25 a week, or in all $900.
