The defendant issued its fire and theft policy on a Marmon car for plaintiff about July 9, 1921. The car was alleged to have been stolen from the premises of the plaintiff about February 8, 1922, and found near a small town in the county the following day totally destroyed by fire. The defendant refused to pay the loss and plaintiff commenced his action for recovery under the terms of the policy.
