OPINION

MATTHEWS, Justice.

Daniel Acevedo was a permanent employee of the City of North Pole working as a police officer. While he was so employed, *132Acevedo had his name placed on the November 3, 1981 ballot as a candidate for a three-year term on the North Pole City Council. Acevedo was elected to that position, receiving more votes than any other candidate running in the election. The North Pole City Council certified the election results and declared Acevedo the winner of a three-year seat on the Council.
