Currently pending before the Court is the Defendants’ Motion to Dismiss the First Amended Complaint (Docket No. 29), filed February 1, 2010.1

Background

In this lawsuit, thirteen individuals2 who have worked at the Idaho National Laboratory (“INL”) for more than fifteen years seek benefits from the Idaho National Laboratory Employee Retirement Plan (“the Plan”). The individuals are currently working for Bechtel BWXT Idaho, LLC (“Bechtel”) at the site.
