— The appellee, Isabella Young, on the 18th of May, 1896, filed her statement of claim in the office of the clerk of the court below against the estate of John Pence, deceased. The appellant, executrix of the last will of said decedent, having rejected the claim, it was transferred to the issue docket. Thereafter, on the 7th of May, 1897, the appellee filed an amended statement of claim, or complaint, to which the appellant demurred for want of sufficient facts ■,to constitute a causé of action.
