This was an action commenced Eebruary 10, 1900, on the official bond of Henry Hubler, recorder of Cass county. The proceeding was commenced as a claim against the estate of the principal, deceased, and in the circuit court the sureties were brought in as additional defendants. December 1, 1889, one William Murphy executed his mortgage on certain land in that county to the relatrix to secure the payment of his promissory note for $683.02, payable to her two years from that date.
