The charge and specification under which the accused in this case was tried by a general court-martial alleged that, on January 2, 1951, he had deserted his ship, and had remained absent in desertion until his apprehension on May 21, 1954. However, the court-martial found that, although he had been guilty of absence without leave for the period named, he lacked the state of mind required for desertion.
