This cause comes before the Court on Defendant Florida Power & Light Company’s Motion to Dismiss the Amended Complaint with Prejudice 1 and Aquatherm’s Response 2 to the Motion.

Procedural History

Plaintiff Aquatherm Industries, Inc. filed its initial action against Defendant Florida Power & Light Company (“FPL”) in Florida state court alleging violations of Florida’s antitrust laws.
