GURFEIN, District Judge:

This is an action challenging the constitutionality of New York’s warehouse-men’s lien laws, N.Y.U.C.C. §§ 7-209, 7-210, which grant a warehouseman a lien and the right to sell stored goods for warehouseman’s fees allegedly due without granting the owner of the stored goods an opportunity for a hear*411ing prior to the imposition of the lien and sale. The plaintiff Brooks individually and on behalf of all others similarly situated seeks declaratory and injunctive relief and money damages.
