Taylor, S.. Mary A. Balfe died December 24, 1913, leaving a last will and testament by which she appointed her husband, Thomas F. Balfe, executor and trustee, with broad discretionary powers with respect to investments, and in the event of the death, resignation or other incapacity of her husband to act as such executor and trustee, she appointed “in his place and stead ” the accountant here, the Title Guarantee and Trust Company.
