APPEAL FROM THE COURT OF APPEALS OF THE DISTRICT OF COLUMBIA. The facts, which involve the rights and duties of trustees of an estate, are stated in the opinion. The trustees’ failure to account fully in this cause, and the futility of their attempt to diminish their accountability by obtaining the Massachusetts probate decree of April 25, 1899, was not cured by acquiescence. The trustees are accountable for diminishing the estate.

William A. Richardson, for some years before his death Chief Justice of the Court of Claims of the United States, died at Washington, D. C., October 19, 1896. By his last will and testament, dated August 9, 1895, he described .himself as “Chief Justice of the Court of Claims at Washington, a citizen and inhabitant of Cambridge, in the County of Middlesex and Commonwealth of Massachusetts, and having property in said County.” By his will he appointed his brother George F.
