This Freedom of Information Act case is before the Court on defendants’ motion to dismiss or, in the alternative, for summary judgment and on plaintiffs cross-motion for summary judgment. 1 After careful consideration of the parties’ papers and the attached exhibits and declarations, the Court concludes that the Vaughn Index submitted by the Department of Homeland Security (“DHS”) and accompanying declarations are inadequate for the Court to resolve either party’s motion on the merits.
