LATIMER, Justice.
The dispute in this case arises out of an attempt made by the State Engineer to enforce payment of such sums of money as have been assessed against the water users of Little Bear River system in Cache County, Utah. A sketch of the distribution system of the river is attached for reference purposes. The assessments were made to defray the expense of administering the distribution of the waters of the Little Bear River under what is commonly referred to as the Kimball Decree.
