This is an appeal from a judgment in favor of plaintiff, and an order denying the defendant a new trial.

The action was brought to recover damages for injuries sustained by plaintiff while working as an employee about defendant's saw-mill, situate in the county of Fresno. It is alleged in the complaint that the injuries were caused by defective machinery used in the mill, and that the defects were known to the defendant, and unknown to the plaintiff.
