MEMORANDUM AND ORDER

McKENNA, District Judge.

Plaintiff Hilda Semerdjian (“Plaintiff’) brings this action against Defendants McDougal Littell (“McDougal”), a division of Houghton Mifflin Company, and R.R. Donnelley & Sons Company (“Donnelley”) (collectively, “Defendants”), alleging copyright infringement. Defendants move for partial summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure on the issue of disgorgement of Defendants’ profits under the Copyright Act, 17 U.S.C. § 504(b).
