Plaintiff, Michael Bergt (“Bergt”), filed suit against defendants, McDougal Littell, a division of Houghton Mifflin Company (“McDougal”), and R.R. Donnelley & Sons Company (“Donnelley”) (together, “defendants”) for copyright infringement and fraud. 1 Pending before the court are three motions for partial summary judgment.
